Terms & Conditions
Guarantee: We aim to supply trees, carefully packed to reach you in perfect condition. Should you be at all dissatisfied with their condition on arrival, please let us know within 4 days, and we’ll arrange an appropriate replacement. We are only liable for the cost of the goods as quoted on the website. Any carriage costs to replace the tree will have to be met by the customer. We cannot be held responsible if any tree dies as a result of frosty or inclement weather. In this case no replacement will be provided.
Quality: If you are not happy with your plants when you inspect them after delivery, call or email us immediately. All the trees you buy from us that are then planted in the UK are guaranteed for 12 months after you receive them. If your trees die, you only have to pay for the delivery of the replacements.
We will REPLACE them free of charge at the start of the next season, if:
. You did not suffer from a hose pipe ban.
. You do not live in a geographical location affected by flooding.
. You send us at least 2 clear, in-focus photographs (preferably digital) as soon as you think there is a problem. One from a distance to show the planting area, and one close up. We may also ask for a sample plant for analysis.
. You meet the cost of carriage for the replacements.
. The tree has not died as a result of over pruning, lack of water/over watering.
Please note that a like for like replacement will be offered, we regret that we do not offer a monetary refund.
This guarantee, which is not transferable, in no way affects your legal rights.
We have the right to inspect the plants in situ and our guarantee is void if they have been removed without our receiving 7 days notice in writing.
The planting of any of our Goods is an expression of your satisfaction with the delivery of our plants. You must then recognise that they are perishable and that we have no control over the conditions in which you keep them, the ground in which they are planted, the manner in which they are planted or the way in which you tend your trees afterwards. Their health is your sole responsibility.
Delivery charges are calculated from our website when placing your order.
The prices are for delivery to mainland UK and the Isle of Wight. We do not promise to deliver on any particular day of a week unless we arrange for our own van to be used. This may attract an agreed surcharge, You will be advised of this prior to your trees being dispatched. Courier costs for trees other than maidens will be advised prior to delivery, if you live outside of the postcode areas shown on our website.
Delivery Address: We will deliver the Goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the Goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the Goods once they have been delivered in accordance with your delivery instructions.
Delivery outside the UK: We do deliver to other destinations including Europe. You will be advised on charges to these locations before delivery.
Payment: All payments will be charged at the published price list current at the date of order. No charge is made to a consumer for credit card payments. Payment for on line ordering is via paypal, however should you wish to telephone your order, we accept MasterCard, Visa and Switch cards, personal checks and bank or building society cheques (all cheques made payable to Commar Services Ltd.) Orders are taken on the understanding that we charge your account at the time when the order is taken even though it may not be possible to supply the order until a much later date. No dispatches will be made until full payment is made.
Prices: Prices include VAT where applicable. We reserve the right to revise any prices in the event of unforeseen circumstances or a change in the VAT rate. VAT does not apply to fruit trees.

Complaints: It is our aim to acknowledge complaints within 5 working days, of receipt of your complaint and will keep you advised about progress.
Cancellation: If you wish to cancel an order, you should contact us by email. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly, at your cost. If the item is large, then we can arrange collection for you and will charge you for this at cost. We reserve the right to cancel any order. Your statutory rights are not affected by any of these business terms. Should you cancel your order, once payment has been made by credit card, unfortunately there will be a £6.00 cancellation fee due to credit card charges, which will be deducted from the total amount. Alternatively you may wish to take a gift voucher to the full amount.
Cancellation by Customers once an order of Bare Root trees have been lifted: Once you have been advised that your order has been lifted, if you then choose to cancel your order a charge of 20% of the value of the trees will made. This charge covered the costs incurred by Grow in lifting the trees, transporting them to our Brogdale site and a repotting charge to protect the trees.
Gift Vouchers: Our vouchers can be purchased either by phone, through our website or by calling into Grow at Brogdale. Other than shop purchase where the voucher is collected in person, they will be delivered by post to an address we have been given. All vouchers include a unique number. They can only be redeemed as full or part payment of products from our shop or website. When ordering you should provide a delivery address and an email address correctly. We cannot be held responsible if the address is entered incorrectly and someone other than the intended recipient receives and uses it.
All Vouchers are dated and expire 12 months from the date of issue.
They cannot be exchanged for cash and may only be redeemed against our products. Where products purchased with a voucher are returned, monies owing will be refunded by another gift voucher.We cannot be held responsible if a voucher is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances.

We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law.
